There is a wide variation in the quality of lawyer referral services, however, even though they are required to be approved by the state bar association. Some lawyer referral services carefully screen attorneys and list only those attorneys with particular qualifications and a certain amount of past experience, while other services will list any attorney in good standing with the state bar who maintains liability insurance. Before you choose a lawyer referral service, ask what its qualifications are for including an attorney and how carefully lawyers are screened.

If legal issues arise that your real estate agent can't answer, you'll need an attorney's help. Although good agents know a lot about the negotiating and contracting part of the process, they can't make judgments on legal questions. For example, what if your prospective new home has an illegal in-law unit with an existing tenant whom you want to evict in order to rent the place to a friend? Only a lawyer can tell you with any certainty whether your plans are feasible. Or, if you're drafting any unusual language for the purchase contract, or are concerned about some language in your mortgage, you may want to have an attorney look the documents over.

Research the attorney. Oftentimes the lawyer directories do not go into great detail about the lawyer's practice, other than the general area of law practiced. Since property law, or real estate law, encompasses a large body of law, you can quickly conduct in-depth research of the attorney by navigating to her website and reading about her specific practice areas. Find a few attorneys who practice the specific type of real estate law that you need.

A good family lawyer is to make sure that you get your fair share of the assets. When the marriage ends it will be necessary to divide the assets, this inevitably results in disagreements. In addition most cases will also require the payment of alimony to one of the parties. This makes coming up with a settlement even more problematic. The only way that you are going to make sure that you get your fair share is if you have a lawyer who is able to protect your rights and ensure that you get a reasonable judgment.

Paperwork will be flying around like a small tornado, and it can be helpful to have someone familiar with the process to deal with it. Other parts of the transaction will be happening quickly too hiring inspectors, negotiating over who pays for needed repairs, keeping up good relations with the sellers through their agent and more.

Totally agree! The process of buying and selling a house is complex. My brother just bought a house which was for sale by owner--and he sold his own house. He hired neither an agent nor a lawyer. Personally, I'd never risk in that way. I would definitely get a good real estate lawyer.
